Park News June 2025

The 2025 Oregon Legislature has passed a bill that makes permanent the 2024 temporary changes to immunity for landowners who allow public use of land without charge for recreational purposes. We wrote about this in December 2023, as cities and park districts grappled with a decision about a trail in Newport. Fields v. City of Newport led the insurance industry to recommend that landowners/jurisdictions close all public trails. The legislature responded with a temporary law in 2024 providing immunity for recreational uses of property. That law is set to expire in January 2026 so the legislature has passed SB179, adding some specifics and making the immunity permanent. It currently awaits the governor’s signature.
